View Full Version : Giving a spare copy of Elements 5 away.

Eighteen months ago I bought Elements 5 and registered it: three months ago I bought a Wacom Bamboo Fun which included Elements 5. I put the second one on a recently acquired laptop.
I now know that an owner can have the same PSE 5 on two of his own computers, and I would like to give one of them, presumably the original one, as I still have the Bamboo Fun, to a friend.
How do I avoid problems with the when the new owner comes to register it?
Many thanks in anticipation of your help.
Bob

I do not know the answer to the question but wondered the same thing myself. I also have an extra copy of PSE 5 with a Bamboo Fun and thought about giving it to someone. I would like to know what others think.

It's probably more important to know what Adobe thinks :)

Seriously, you should read the EULA (End-User License Agreement) to see what it says about transfers. More than likely, a transfer is allowed as long as it's not a "Not For Resale" version (which the copy that came with the tablet may be). If you're pretty sure the EULA allows a transfer, there's a form on Adobe's web site that you have to submit:

http://www.adobe.com/support/service/ts/documents/transfer_owner/ToL_NA.pdf

Hey, you didn't think it was going to be easy, did you? :D

You can get a transfer form from Adobe and transfer the license over :)

What a wonderful crowd you are! Especially when you will be busy writing Christmas cards.
Within an hour of my request I am inundated with replies, for which I am grateful.
However when I downloaded the form from gcherry's letter, I read: "Please note: This Transfer of License is valid only in the U.S., Canada or Mexico"

But I am in England, what are the rules here?

Sorry to be so parochial,

Yours,

Bob

That's funny! The first transfer form I found was only for UK, so I went searching for a different one. Guess I should have looked to see where you were!

Here's the correct form:

Tintinabulum and all,

When I started typing my response, there were only your question and Tina's reply. The last two posts say essentially what I was to contribute.

In the Adobe license agreement that I read (section 4.4, I think), the header is No Transfer and continues with "You may not rent, lease, sell, sublicense, assign or transfer.....". It definitely talking about the user who has "purchased" and registered Photoshop Elements. BUT, as others have pointed out, there is a provision for transferring all right to said software to another person if you give up all rights to the software, both parties agree to the Adobe Licensing Agreement, and this is going through Adobe's transfer department for the transfer of the your registration.

The above would suggest a transfer of registration without any money changing hands. Another issue that I wonder about is whether there are any restrictions as to the home land/nationality of the person to whom the software is to be transferred. If you look at the Adobe download agreements for sales of software, that seems to be involved. Do not know, only wondering.

At any rate, my reading is that this would have to go through Adobe to be legal and OK's by them.

Glenda,

Sorry I took so long to read and type. By the time that I hit the summit reply button, the job was all done.

You did all the work finding those forms. Great job. Thank you. That was valuable information.

You have all been wonderful: many thanks.
Now I know how to transfer the licence (or license, as they spell it in N. America), how to I transfer the number of the disc, which I got with the Bamboo Fun, to my PC?

Sorry to be so ignorant of these things.

Compliments of the season to all of you in the Village,
Bob

Here is another question . IF I have not downloaded or registered the copy that came with the bamboo fun do I still have to transfer anything? Can I just give it away? There are other software that are also on that disc. what about those.
Still thinking about this and all the responses so far have been very helpful and always can find an answer to just about everything here.

Yesterday I telephoned the Adobe UK Helpline to check on whether it mattered whether I gave away the bundled PSE5, that came with the Bamboo Fun, or whether I should keep that and give away the orginal PSE5.
The adviser could not have been more helpful: he said it didn't matter, they were my property: I could give either away. Although I had downloaded the bundled version to my new laptop, I had not yet registered that, so I uninstalled that and installed the original version in its place and registered it. No problem at all, although I haven't used it yet.

Anyway, my problem is solved and my thanks and seasonal wishes to everyone.

Hi Bob ...

Ummm ... I'm not sure that advice was correct.

The problem is that not all Adobe advisers give out the correct advice :)

Oh Dear, Wendy! or perhaps, Oh, dear Wendy, given the amount of help you have given us!

If the Adobe chap was wrong, what should the correct advice have been?
I must emphasise that I had not registered the new (bundled) PSE5.
If I were to give away my original PSE5, whould I have to uninstall that PSE5 then re-install the new one. If I did that, what would happen to my images in the interim?

Happy Festive Season,

Bob

Hi Bob ...

My understanding is that you can only give away (or sell) the bundled version if it is given away with the rest of the original bundle. So theoretically you would have to pass on your tablet too

Or uninstall the one you have at the moment, fill out a transfer form etc ... then reinstall the new one.

... but I would simply give away the unregistered one and accept what the guy on the phone said :D :D (Much easier that way)

Incidentally if you do have to uninstall and reinstall (for any reason) then its OK your images would still be there.

Wendy:)

Hi Bob ...

I found the relevant section in the licensing agreement ... here it is :

When I read that bit in Wendy's last post it was clear that to stay within the rules a bundled PSE5 can only be given away with the object with which it is bundled: the Adobe adviser was simply wrong.
Being a law-abiding Scouser I have accepted that and today I uninstalled my original PSE5 and then installed the new (bundled) PSE5.
I realised that things had changed and it took me a while to work out how to get the files in absolute chronological (not just by date) order: Wendy had told me hw to do that some time ago but I couldn't find her letter but I have just managed that.
Unfortunately, any feeling of virtue at my extreme adherence to the letter of the law has been cancelled by a new problem: when I am in organiser and see a picture I would like to edit, I am quickly told it cannot work on that type of file (they have all so far been Olympus RAW ORF files and the broken image appears and I can no longer get at that image.
What has happened and what should I do?
Yours legally,

Wendy

Hi Bob ...

I didn't realise that you were a Scouser ... I'm originally from Bolton :)

Being a Mac user I don't have the Organiser so I am stuck on this one but hopefully one of the Windows users will be able to help.

"I am quickly told it cannot work on that type of file "

I wonder if it is a question of the version of ACR installed with that PSE 5 that does not match your particular ORF files.

Posts #1 and #2 in the following thread should help find out if you have the correct ACR installed

Correct diagnosis, athegn! Reinstalling Adobe Camera RAW 4.6 solved the problems, although the "Broken " symbol remained until I pressed "Full Edit" on the affected images, wherupon the proper ACR widow appeared.

So thanks to you, athegn and to my fellow Lancastrian, Wendy, for the rapid and spot-on assistance.

I hope you all had a lovely Christmas.
Well, I got Elements 5 going again, but I discovered some of the tags in Organiser had disappeared: I have tried Catalog restore without success, and I don't know how this has happened, or what I should do.
Ideas, anybody?

Many thanks,
Bob
